Photography & Clinical Image Policy

1. Purpose of Clinical Photography
Clinical photographs and 3D skin scan images may be taken:

To assess skin condition prior to treatment

To monitor treatment progress and outcomes

For medical record keeping

For insurance and medico-legal protection
-
For training and professional development (with consent)
-
For marketing and promotional purposes (with separate consent)
Photographs are an essential part of accurate assessment and safe treatment planning.
2. Types of Images Collected
We may collect:

Standard clinical before and after photographs
-
Close-up treatment area images
-
3D AI skin scan images and reports
-
Progress comparison images
These images may contain identifiable facial features.
3. Lawful Basis for Processing
Clinical images are processed under:

UK GDPR Article 6(1)(b) – Performance of a contract (providing treatment)

UK GDPR Article 9(2)(h) – Provision of healthcare

Explicit consent for marketing use
Health-related images are considered special category data and are treated with enhanced protection.
4. Storage & Security
Images are stored securely using encrypted, password-protected systems provided by approved clinical software providers.
Access is restricted to authorised personnel only.
Images are retained in line with medical record retention guidelines (minimum 7 years unless otherwise required by law).
5. Marketing & Social Media Use
Clinical photographs will never be used for marketing purposes without your explicit written consent.
If consent is given:

You may choose whether your face is identifiable or anonymised

Consent can be withdrawn at any time

Withdrawal does not affect images already lawfully published prior to withdrawal
Declining marketing consent will not affect your treatment in any way.
6. Your Rights
You have the right to:

Request access to your images

Withdraw marketing consent

Request restriction of processing (where legally permitted)

Lodge a complaint with the ICO
However, clinical images forming part of medical records cannot be deleted where they are required for legal, insurance or regulatory purposes.
7. Refusal of Photography
You may decline marketing photography at any time.
However, refusal of clinical photography may limit our ability to:

Accurately assess progress

Demonstrate treatment outcomes

Protect both client and practitioner in the event of dispute
